US Dist Ct Judge W M Byrne Jr on Feb 2 denies defense motions to dismiss case against Ellsberg and Russo or declare mistrial; defense asked for dismissal on grounds that defendants' right to fair trial has been 'substantially prejudiced' by Govt's failure to make 'timely disclosure' of documents and correspondence Govt has relating to Pentagon papers, which Byrne ordered that Govt turn over to him in private on April 11 and June 23; Govt began to comply with Byrne's orders only after Jan 18; Byrne says he will consider 'imposing sanctions' on prosecution at 'appropriate time' during trial; motion for dismissal is argued by Ellsberg's atty L B Boudin and A J Russo's attys H P Young and L I Weinglass; Byrne orders that Natl Security Agency official W Gerhardt be summoned from Washington, DC, to testify
