L B Boudin, defense in Pentagon papers case, on Feb 5 asks Judge W M Byrne Jr to preclude Govt from presenting evidence based on 2 of 'top secret' documents in case, '54 Geneva Accord memorandum and 1 vol of Pentagon papers; Byrne says he will consider request; if granted this would have practical effect of throwing out 2 of 8 espionage counts and 1 of 6 theft counts against D Ellsberg; motion was made on ground that there exists exculpatory evidence in 2 documents and that 2 documents are only ones involved in those particular counts; Boudin begins defense cross- examination of Brig Gen P F Gorman, who is highest-ranking Army officer on Defense Dept team that put together Pentagon papers; points out to Gorman that former Pres Johnson, in his book The Vantage Point, disclosed much of same material that had been made public by Pentagon papers; Gorman holds that there is difference, that material is more important to foreign nation when it comes from Defense Dept rather than from press
